Cell phone upgrade fees: Verizon, AT&T, etc. really know how to ruin the fun
News from Boston.com:
More fees? Now all the major cell phone carriers are charging a fee, on top of any other charge they might dream up, to upgrade your phone.
After all the fuss over bank fees – the fuss, that, if you don’t remember, stopped Bank of America from charging for the privilege of having one of their debit cards – it is unfortunate that another enormously profitable business has gone the fee route.
How about making a fuss about this? It stinks. Doesn’t it?
Who hasn’t looked forward to the end of the two years or so of their cell phone contracts and making an additional commitment to get a new – and free – phone. Thank you Verizon, AT&T, T-Mobile and Sprint, for ruining the fun.
Verizon this week became the last of the biggies to charge this new fee. AT&T and Sprint are the priciest at $ 36. Verizon undercut them by $ 6 and is charging $ 30, while T-Mobile looks practically generous levying half the fee of AT&T and Sprint. That’s still $ 18 more than they were charging before this fee-fest.
“I am very concerned that consumers have little choice in the cellular phone marketplace except to pay this new activation fee when upgrading to a new phone,” state Consumer Affairs chief Barbara Anthony said. “With the announcement this week by Verizon, all four cellular phone carriers are charging upgrade fees – in additio…………… continues on Boston.com

North Carolina town plans to ticket drivers for any cellphone use
News from Fox News:
If you’re driving through Chapel Hill, N.C., and your cellphone rings, don’t answer it. Starting June 1, you can get a $ 25 dollar ticket for talking on your cellphone while driving within the city limits.
In a close 5-4 vote, the town council decided to ban any phone calls made while operating a vehicle – that includes hands-free devices, such as Bluetooth and speakerphones.
Chapel Hill, home to the University of North Carolina, is the first municipality in the nation to enact a complete ban on all cellphone use in cars. Town council member Penny Rich says a large number of pedestrians and bicyclists navigating sidewalks and streets among drivers who tend to multitask is a dangerous mix.
“The distraction is not holding the phone. The distraction is actually the conversation,” Rich said. “So just holding the phone is not what is making you drive poorly, it’s the conversation.”
The ban is a second-offense violation. So the Chapel Hill police will not pull you over if they see you talking on a phone. A ticket will only be issued if they stop you for another traffic violation, such as speeding or running a red light, and find that you were talking on your phone.
The National Transportation Safety Board supports the ban and is trying to promote statewide cellphone bans in all 50 states.
“If you need to make that call at 5 o’clock an…………… continues on Fox News

Verizon gamed cell phones, suit says
News from New York Post:
Verizon Wireless meddled in the business affairs of its largest New York store operator so it could artificially inflate pre-paid phone activations, a lawsuit filed yesterday in Manhattan state court charges.
The cell-phone giant pulled off the alleged scam by working with sub-agents of the retailer to activate inexpensive pre-paid phones for six months — phones that it sometimes would not even give to customers — in order to increase activation numbers, the suit alleges.
The higher activation numbers would boost profits and make Verizon Communications, the parent of the cell-phone provider, appear more profitable than it actually was, the suit charges.
The suit, which seeks to recover more than $ 1 billion in damages, was filed by ZCom, which runs roughly 120 NYC area stores, 90 of which are subleased. The suit alleges that Verizon Wireless worked the scam with some of those sub-lessors.

Smaller Cellphone Carriers Top Verizon, Sprint, T-Mobile and AT&T
News from Clarksville Online:
Consumer Cellular and U.S. Cellular Sit Atop the New Consumer Reports Cell Service Provider Ratings; AT&T Remains at the Bottom
Yonkers, NY - When it comes to cell-phone carriers smaller may be better, according to a new satisfaction survey of Consumer Reports online subscribers. At the top of the Ratings for standard service providers were Consumer Cellular, a national carrier that uses AT&T’s network, and U.S. Cellular, which operates in just over half the United States.
Credo, which offers service to much of the country on Sprint’s network, also bested the major carriers. AT&T, America’s second-largest carrier, again found itself at the bottom of the Ratings.

Black Friday: Verizon offering free Droid Incredible 2, $ 200 Xoom
News from Los Angeles Times:
Black Friday isn’t here just yet, but Verizon Wireless is already offering some limited-time-only discounts on tablets and smartphones to kick off the holiday shopping season.
One standout is an HTC Droid Incredible 2 smartphone in a loud red, offered free with a 2-year-data plan. The Incredible 2, which launched in May, isn’t the newest handset from Verizon to run Google’s Android operating system, but it’s still one of the nicest phones available from the carrier.
The model features a four-inch touchscreen, an eight-megapixel rear camera with dual-LED flash and 720p video, and a speedy one-gigahertz Qualcomm Snapdragon processor. The handset runs on Verizon’s 3G network.
One downside is that the phone comes with only eight gigabytes of storage via an included microSD card. (The gigabyte or so of built-in storage is taken up by the Android operating system and prel…………… continues on Los Angeles Times

The trustee liquidating Bernard L. Madoff’s firm can have a jury determine whether he’ll recover allegedly improper transfers of funds from the confidence man to the owners of the New York Mets.
U.S. District Judge Jed Rakoff said in a Nov. 23 ruling that the trustee, New York lawyer Irving Picard, has a right to let a jury instead of Rakoff himself decide the issue when the case goes to trial in Manhattan on March 19.
The judge in September dismissed most of Picard’s $ 1 billion claim against Sterling Equities Inc. partners Fred Wilpon and Saul Katz, who own the Major League Baseball team. Rakoff didn’t say whether Picard can successfully maintain a “fraudulent-conveyance” claim against them.

Verizon Wireless publicly admits selling customers’ personal data
News from KHOU:
HOUSTON – Verizon Wireless is assuring customers that their privacy won’t be comprised after it became the first mobile phone company to publicly admit that it was selling some of its customers’ personal data to third parties.
The carrier stresses that all of the shared data is anonymous and can’t be traced back to individual consumers.
Within the growing smartphone market, Verizon certainly has a loyal following.
“I love the fact that it doesn’t drop calls,” said Taisha Terry, who also loves to surf the web on her iPhone.
But now she’s learning Verizon’s making a lot of money selling some of that data.
“It’s personal information,” she said. “It’s my phone, you know?”
Verizon just became the first wireless carrier to admit it’s providing some of that information to third parties. That information includes what sites you visit, what apps you download and even where you drive.

Verizon Stock Riding Wireless Wave To $ 43.50
News from Forbes:
Verizon recently announced its Q3 earnings which received a boost from better-than-expected postpaid wireless subscriber additions. While rival AT&T added more new wireless customers in total (2.1 million versus Verizon’s 1.3 million), Verizon landed almost triple the number of more lucrative postpaid customers. However, the total number of iPhone sales proved to be a dampener of sorts as the carrier could activate only 2 million units compared to the 2.7 million AT&T managed to last quarter. The carrier’s wireline segment grew sequentially on the back of solid gains in its consumer and business segments.

Earnings Preview: AT&T to Report 3Q Results
News from ABC News:
AT&T Inc., the largest telecommunications company in the U.S., reports results Thursday before the stock market opens
WHAT TO WATCH FOR: AT&T was in a holding pattern in the third quarter. It’s usually an important one for the carrier, since there’s been a new iPhone at the start of the quarter or just before it for the last four years. But this year, the launch of the new iPhone model was delayed until last week, after the end of the third quarter.
That means analysts are looking for business-as-usual results from AT&T. Still, the number of new subscribers on contract-based plans will be closely watched. Customers who sign contracts are the most lucrative for the carriers, and AT&T has been a leader in attracting them, thanks to the iPhone.
This year, however, the number of new subscribers has been curtailed sharply, as Verizon Wireless started selling the iPhone in the first quarter. For AT&T, that meant it gained just 62,000 net new subsc…………… continues on ABC News

Verizon Wireless, the largest U.S. wireless operator, and Sprint, the third-biggest, showed no immediate stock of iPhone 4S 16-gigabyte models for pre-order on their websites. AT&T says its new 4G LTE smartphones are thinner and more efficient than Verizon’s, boasting a new technology that may help AT&T compete against Verizon’s much bigger LTE network.
Ralph de la Vega, chief executive of AT&T’s wireless and consumer unit, told CNET the new phones will launch in the fourth quarter. The phones were slightly delayed because the technology was still being developed, but de la Vega said, “We think it’s worth the wait.”
The phones use a circuit-switch fallback, or CSFB, which allows them to run on a 4G network, flipping back to 3G when they are out of an LTE coverage area. De la Vega did not say which manufacturers are making the technology

Sprint and Verizon To Unlock The iPhone 4S For International Travelers
News from Gizmodo:
International travelers who want an iPhone 4S for its global roaming should buy their handset from Sprint or Verizon Wireless. These two carriers will unlock your phone so you can use it with any international rate plan.
It all comes down to the micro-SIM slot and what each carrier is going to do with it. AT&T locks the micro-SIM slot so you can only use the phone on its network. When you travel overseas, you must purchase AT&T’s costly international roaming plans.
Sprint and Verizon, though, use CDMA for their domestic service and the micro-SIM slot for international service only. These two carriers can unlock the micro-SIM card slot and not worry about people jumping ship to another carrier.
Between Sprint and Verizon, Sprint offers the better deal on the iPhone 4S. It’s selling the handset with an unlimited data plan and an unlocked micro-SIM slot. Verizon does not have an unlimited data plan and will unlock your handset, but only after you have been…………… continues on Gizmodo
