At least 4 dead after train crashes into trailer during Texas veterans parade
News from Fox News:
DEVELOPING — Multiple deaths and dozens of injuries were reported after a train crashed into a trailer carrying veterans during a parade in Texas.
A flatbed 18-wheeler truck was reportedly carrying veterans and their families for the “Hunt for Heroes” parade in Midland when it was hit by a train.
At least four deaths have been reported and at least 16 people have been taken to nearby hospitals, according to MyFoxDFW.com.
“Show of Support” president and founder Terry Johnson tells the Midland Reporter-Telegram that a Union Pacific train slammed into a trailer that was on its way to the wounded veterans event about 5 p.m. Thursday.
He says there are “multiple, multiple” injuries and organizers still are trying to account for everyone.
The parade was supposed to end at a “Hunt for Heroes” banquet before wounded service members were treated to a deer-hunting trip this weekend.
The Associated Press contributed to this report.

Racial Balance at Risk as Supreme Court Hears Texas Plan
News from Businessweek:
The last time the U.S. Supreme Court ruled on university affirmative action, upholding it in 2003, Justice Sandra Day O’Connor predicted the practice would outlive its usefulness in 25 years.
Now the end may come a lot sooner than that.
The high court revisits race-based admissions today, hearing the case of a rejected white applicant to the University of Texas. The court’s reconstituted membership makes new limits probable, even as dozens of the nation’s largest companies, such as Microsoft Corp. (MSFT) and Wal-Mart Stores Inc., (WMT) call for continued use of affirmative action to ensure a diverse workforce.
“It’s just a matter of time before the use of race is restricted, prohibited,” said Ward Connerly, a former member of the University of California Board of Regents who led a successful fight to end preferences at public in…………… continues on Businessweek

Skydiver cancels 2nd try at supersonic jump in NM
News from Boston.com:
ROSWELL, N.M. (AP) — Blame it on the wind. Again.
For the second straight day, extreme athlete Felix Baumgartner aborted his planned death-defying 23-mile free fall because of the weather, postponing his quest to become the world’s first supersonic skydiver until at least Thursday.
As he sat Tuesday morning in the pressurized capsule waiting for a 55-story, ultra-thin helium balloon to fill and carry him into the stratosphere, a 25 mph gust rushed across a field near the airport in Roswell, N.M.
The wind rushed so fast that it spun the still-inflating balloon as if it was a giant plastic grocery bag, raising concerns at mission control about whether it was damaged from the jostling.
The balloon is so delicate that it can only take off if winds are 2 mph or below on the ground.
‘‘Not knowing if the winds would continue or not, we made the decision to pull the plug,’’ mission technical director Art Thompson said. Baumgartner’s team said he has a second balloon and intends to try again.
Thompson said the earliest the team could take another shot would be Thursda…………… continues on Boston.com

At least 11 killed in single truck crash in Texas
News from CBS News:
Updated 12:48 p.m. ET
(CBS/AP) GOLIAD, Texas – Authorities say a pickup truck has crashed in South Texas, killing 11 people in the vehicle and injuring 12. All 23 passengers were in the same Ford F-250 truck, according to officials.
Louann Presas, a spokeswoman for the Texas Department of Public Safety, says the crash occurred about 7 p.m. CDT Sunday near Berclair when the truck ran off the highway and crashed into some trees. The unincorporated community is about 100 miles southeast of San Antonio.
“The truck left the roadway and struck two very large trees,” Texas Department of Public Safety spokesman Gerald Bryant told CBS affiliate KENS in San Antonio.
According to Bryant, a total of 23 people of “a variety of ages,” including some children, were in the vehicle. The victims have not yet been identified, he said.
The alleged driver was ejected but is alive, Bryant said, and six others inside the cab of the truck were pronounced dead at the scene. Another five victims outside of the pickup also died at the scene, he said.
She says the extent of the injuries to the surviving victims wasn’t immediately clear. Crash investigators were still at the scene around 11 p.m. CDT.

Investigators find Batman mask, poster at movie theater massacre suspect’s …
News from Fox News:
AURORA, Colo. – Investigators searching the apartment of the suspect in a mass shooting at a Colorado movie theater have found multiple Batman-related items.
A law enforcement source confirms to Fox News investigators seized a Batman poster and a mask connected to the Batman movies from James Holmes’ apartment, though they did not say which character the mask was of. Holmes is accused of killing 12 and injuring 58 in a shooting massacre at a packed theater of moviegoers watching the premiere of the latest Batman movie.
A law enforcement official told The Associated Press the mask found was a Batman mask. Investigators also took multiple other items from the apartment, including a computer tower.
A law enforcement source says in addition to multiple booby traps and ammunition, officials also removed 10 gallons of gas ready to explode.
“The idea was…he wanted to burn this place down,” the source said. “And the gas would have made that fast.”
Agents say they believe the person who opened the door would have been killed, setting off a fire storm that could have trapped people inside the building in the middle of the night.
Ben, a student who lives two floors below Holmes, tells Fox News he only saw Holmes twice since living in the building. He said Holmes was quiet, and kept to himself.

U.S. to step up enforcement against texting and cell phone use while driving
News from Detroit Free Press:
To prevent deaths attributed to distracted driving, U.S. Secretary of Transportation Ray LaHood said Thursday the government will spend $ 2.4 million to step up enforcement in California and Delaware of bans on texting and cell phone use while driving.
The investment is part of what LaHood called a new “blueprint for ending distracted driving” that includes more education and law enforcement.
The pilot program follows a similar initiative in Hartford, Conn., and Syracuse, N.Y., where vigilant ticketing reduced the frequency of driving while using mobile devices. The result was a 72% drop in texting while driving in Hartford and a 32% decrease in Syracuse, LaHood said.
Today, 39 states have texting bans and 10 ban all hand-held phones. Three years ago, only 18 states had texting laws and seven had bans, LaHood said.
Still, 1 in 10 highway fatalities is the result of distracted driving, resulting in at least 3,092 victims in 2010.
“I call it an epidemic,” LaHood said, “despite the fact those deaths are 100% preventable.”
LaHood also called on Congress to toughen its laws and enact a nationwide ban on cell phone use while driving.
“It’s time for the states that have been lagging behind on distracted driving to step up,” said Ellen Bloom, head of federal policy at Consumers Union, the advocacy arm of Consumer Reports.

APNewsBreak: Mother of student at Kansas military school claims cellphone …
News from Washington Post:
WICHITA, Kan. — The mother of a 14-year-old boy says a cellphone video depicting her son struggling to stand on two broken legs is proof that her son was harmed while attending a Kansas military school and supports claims in a federal lawsuit that the school encouraged a culture of abuse.
The 3:39-minute video clip obtained exclusively by The Associated Press depicts Jesse Mactagone of Auburn, Calif., at St. John’s Military School wobbling and pleading for help as an instructor tries to make him stand. Both of the boy’s legs were broken during the four days in August 2011 that he attended the school, and he was hospitalized before being flown home. He no longer attends the school.
Mactagone and the families of six other students filed a federal lawsuit in March seeking unspecified damages, claiming the school in Salina allowed and encouraged abuse. St. John’s has settled nine previous abuse lawsuits filed since 2006. However, law enforcement authorities in Kansas have declined to file assault charges against anyone at the school, citing a lack of evidence.
“How many more kids need to be hurt before they are heard?” his mother, Jennifer Mactagone, said in a phone interview from California. “Can you imagine what some of these boys go through, how scared they are? This is the worst case of bullying I have seen and it is all orchestrated by…………… continues on Washington Post

Cellphone of slain bride’s husband used in Texas, authorities say
News from Chicago Tribune:
The Chicago man accused of stabbing to death his new bride in Burbank might have traveled to a Texas town near the Mexican border, authorities said Thursday.
According to details included in a federal warrant approved Thursday, Arnoldo Jimenez’s phone was tracked to Hidalgo, Texas, Sunday night, just hours after Estrella Carrera’s body was found in the bathtub of her apartment. She still was wearing the sparkly silver dress she had worn to celebrate her wedding Friday. The FBI on Thursday night declared the search for Jimenez an international manhunt.
The cellphone belonging to Jimenez, 30, was last used in the Chicago area Saturday, according to the court documents. It was used again through southern Illinois, near Memphis, Tenn., through Arkansas and then into Texas, records show.
The new documents also reinforce information Carrera’s family conveyed to the Tribune about an emotional call Jimenez made to his sister.
“On (Sunday) Jimenez spoke with his sister by telephone, telling her he and Carrera had a bad fight and he left her bleeding,” according to court documents. Another “close associate of Jimenez” told authorities that Jimenez told the associate “he was leaving the state of…………… continues on Chicago Tribune

Gun enthusiasts unite at NRA convention
News from CBS News:
(CBS News) ST. LOUIS – Avid hunter Rob West drove from Chillicothe, Ohio, to St. Louis this week to join some 70,000 fellow National Rifle Association members at the organization’s annual convention, where seven acres of guns and gear were on display and where politics was never far from anyone’s mind.
For the NRA, which opposes any restrictions on gun ownership and President Barack Obama’s re-election, the Second Amendment right to bear arms is sacrosanct.
“We don’t want politicians or Supreme Court justices who are going to try to take that liberty away from us,” West said in an interview under the Gateway Arch.
West and the NRA leadership cite the possibility that President might appoint more Supreme Court Justices in a second term as a prime reason to work for his defeat. It was a 5-4 vote by the current conservative court majority (Roberts, Scalia, Kennedy, Thomas, Alito) in a 2008 case that solidified the right of individuals, outside of a militia, to own guns.
On the legislative front, the NRA’s top priority for its 4 million members is to increase the portability of their guns. The organization is lobbying Congress to pass a new national law that would allow gun owners with “concealed carry” permits to bring their guns into every other state that allows qualified residents to carry concealed firearms.

Texas drops another close loss at critical time, 77-72 to No. 13 Baylor
News from Washington Post:
AUSTIN, Texas — At the end, Texas guard J’Covan Brown blamed himself..
It was easy to do. His turnover with 12 seconds left all but sealed at 77-72 loss to No. 13 Baylor on Monday night.
But there was plenty of blame to go around the Texas locker room for this defeat, the Longhorns’ eighth loss of the season by six points or less. And this one comes at a crucial time when the Longhorns are desperately trying to boost their NCAA tournament resume.
“We gotta finish the job,” freshman guard Myck Kabongo said., “No one remembers the team that loses. It’s all about winning. Yeah, you can say it was close but you have to win.”
What Texas (17-11, 7-8 Big 12) couldn’t do was stop Baylor (22-5, 10-5) forward Quincy Acy, who carried the Bears on his strong shoulders with 22 points and 16 rebounds.
Baylor rallied from a 12-point deficit behind the 3-point shooting of Brady Heslip early in the second half and Acy’s big game. Seven straight points by Acy pushed the Bears to a five-point lead with under 3 minutes to play. Pierre Jackson finished out the win with six consecutive free throws in the final 28 seconds.
Texas trailed 73-70 with 12 seconds left with a chance to shoot for a tie. Baylor set up a trapping double team on Brown who fired a wild pass that was easily picked off by A.J. Walton.

Deron Williamsw helped create the craze at the Garden, but Monday he shut up the Linsaniacs.

A motivated Williams went off against the Knicks, scoring 38 points on a career-high eight 3-pointers before fouling out with a 3:07 remaining and the Nets holding a 12-point lead. He also helped hold Jeremy Lin to 21 points, a lot of it in the fourth quarter with Williams on the bench, in the 100-92 victory.
Near the end of the third quarter – after Williams hit his 10th straight point to give the Nets a 19-point lead – he uncharacteristically celebrated by throwing up a 3-point sign and jumping to body-bump teammate
