Phone merger is put on hold

WASHINGTON — AT&T and T-Mobile USA appeared to edge closer to scrapping their proposed merger, saying Thursday that they had withdrawn their application to the Federal Communications Commission to join their cellular phone operations.
Deutsche Telekom, the parent of T-Mobile, and AT&T said in a joint statement that they still intended to pursue the $ 39 billion merger and would prepare for a federal antitrust lawsuit that is seeking to block the deal.

The first time U.S. District Judge Ellen Segal Huvelle in Washington heard an antitrust challenge to an AT&T Inc. deal, she said her hands were tied in assessing a smaller competitor’s objection to the proposed acquisition.
Mid-Tex Cellular Ltd., a rural cellular company based in DeLeon, Texas, argued that the $ 4.5 billion takeover of Dobson Communications Corp. threatened its business and that the Justice Department wasn’t treating the “entire market” consistently when it agreed to settle the case.
In a ruling approving the deal, Huvelle said that while Mid-Tex may be correct, under the law the government had “broad discretion” to settle the case with Dallas-based AT&T “within the reaches” of the public interest.

Feds make bad call on cell-phone merger

With the economy tanking — again — the government needs to start leaving the free market alone. Instead, the Obama administration’s Justice Department recently launched an anti-trust lawsuit to prevent AT&T Inc. from acquiring T-Mobile USA Inc. The companies are the second-and fourth-largest U.S. cellphone companies, respectively.
The Justice Department’s announcement said, “The department said that the proposed $ 39 billion transaction would substantially lessen competition for mobile wireless telecommunications services across the United States, resulting in higher prices, poorer-quality services, fewer choices and fewer innovative products for the millions of American consumers who rely on mobile wireless services in their everyday lives.”

SACRAMENTO–Senate Bill 26, authored by Senator Alex Padilla (D-Pacoima), won final legislative approval with a unanimous, bipartisan vote of the State Senate. SB 26 would crack down on the smuggling and possession of cell phones and other wireless communication devices in California prisons. The legislation now goes to the Governor for his signature.

If a proposed merger between AT&T and T-Mobile is approved, most Covington County residents will soon have access to 4G service.
AT&T announced earlier this year its $ 39 billion plan to acquire T-Mobile USA from the German-owned Deut-sche Tele-kom.
The acquisition would address Ame-rica’s spectrum exhaust challenges.
Spectrum is the range of airwave frequencies that enable devices from broadcast television to cell phones to mobile broadband and even baby monitors.
Gigi Armbrecht, regional director for AT&T Alabama, explained spectrum like this.
“It’s like multiple lanes on a highway,” she said. “As more people use wireless devices, there needs to be more space for them, like an additional lane of traffic.”

Pending regulatory antitrust approval, Bellevue-based T-Mobile USA will soon be a part of AT&T, and consumers will have one fewer choice when it comes to cell phones.
That’s bad, says a consumer advocacy group. Very bad.
The group, Free Press, has created four satirical videos (embedded above) that raise some important questions about the proposed $ 39 billion merger. And they’re similar concerns to those U.S. Rep. Jay Inslee, D-Wash., recently posed to the two companies’ CEOs.
